If you forget what is legal and what is illegal, ask the question, is it right? You wouldn't download anything that was made by some publishers, so why would you others? It is in fact stealing a game, and then playing it. Is stealing right? Would you steal a game from the store, and then play it? It's the exact same thing.
Laws are there to protect people and property. Laws are there, because we live in a society. People don't have to, and don't want to accept bad behavior, which is why the laws are there.
People have the right to have their own opinions, but just because someone says that they feel it's right to download a game because such and such, is wrong to do it. They can feel whatever they want to, but it doesn't make it right to act on it.
What's wrong in the abondonware case, is that you are stealing property from others. Think about this scenario. Strategy First now holds the rights to the Jagged Alliance series. They have the right to release Jagged Alliance 1 in the stores. It seems silly, since not many would get it, but they have the right to do it. Would you still hold the same position that it is right to download it? All those abondonware titles are property of others, and those others have the right to release them again. How is it right that you can steal property from them?
hm - soviel dazu.
